Yes. If you are an individual who has a pending DUI case and you feel that you may have an issue with alcohol, entering into some sort of alcohol education classes says a lot to the court. It says that you are ready to take responsibility for your actions and goes a long way towards helping your attorney obtain the best result possible. While not all judges are the same, most will look at this action as a positive change that you have made in your life. As such, they will take this into consideration when determining an appropriate sentence.

For non-residents who receive a DUI while passing through Illinois it can be a confusing time. However, with the right attorney things can go very smoothly. The biggest concern that I see with these clients is how they are going to comply with the court ordered recommendations after they have come to an agreement in their case.

The most common concerns deal with completing community service, alcohol classes, and other court-ordered programs. If you have an attorney who is familiar with the court, they can request that you complete all of your court orders “through the mail.” This means that as long as you report to the social services department of the respective court you are in, you can complete all requirements in your home town. Every town has similar programs that can satisfy what would be required in Illinois. As long as proof is shown that you completed your treatment, community service, and paid your fines/costs, you should be able to complete everything very smoothly.

This is why it is so essential that you find a DUI attorney with local knowledge to get you the best possible outcome.

If you have questions concerning DUI Court Order For Non-Residents, call Suhre & Associates any time at 312-450-6639 to speak with an attorney and find out what can be done in your particular situation.

I get this question a lot. The answer is that police often scan license plates. When this happens, they are typically able to see whether or not the registrant of the vehicle has a valid license. This means that you do not have to be committing a crime to find yourself pulled over by the police.

This is why it is so important to refrain from driving if your license is under suspension. You are only causing more issues for yourself including the need to hire an attorney for a new case. Additionally, if you have a case pending, it makes it more difficult for your attorney to get you the best outcome possible when there are new violations.

This is because the license suspension process starts on the 46th day from the date of your arrest for a DUI. This process is initiated by the Secretary of State, not the court. Further, the suspension process is separate and happens by default, having nothing to do with your guilt or innocence in the courts. However, convictions for a DUI (meaning non-supervision dispositions) can result in license revocation. This is why it is important that you hire an experienced DUI attorney who will file a Petition to Rescind the Statutory Summary Suspension right away.

If your attorney gets your Petition to Rescind granted immediately, it is possible to avoid the start of your license suspension. However, if your attorney gets this granted after the suspension has begun, you will still be able to get your license back prior to the end of the suspension period.

If you have questions concerning License Suspensions, call Suhre & Associates any time at 312-450-6639 to speak with an attorney and find out what can be done in your particular situation.

There are many ways that an individual can violate a court order for supervision including but not limited to the following: 1-picking up a new charge; 2-failing a court-ordered drug test; 3-not completing community service; 4-not paying fines/costs; 5-not completing required alcohol classes, etc. In Cook County, if you fail to complete a court supervision order there is typically a “violation hearing” which occurs where you are called before a judge to address the reasons why the violation occurred. It is a good idea to have a qualified DUI attorney representing you at this type of hearing.

Typically, if we are dealing with a first violation, your attorney should be able to get you additional time to comply. Although jail is possible it is unlikely for a first violation. However, if you fail to comply by a subsequent date set by the court your supervision could be terminated unsatisfactorily resulting in various ramifications.

If you have questions concerning your Court Supervision, call Suhre & Associates any time at 312-450-6639 to speak with an attorney and find out what can be done in your particular situation.

Anytime you have a DUI matter pending resolution it is never good to obtain new charges. This is why it is so important that you pay attention to your license suspension start/end dates and take appropriate measures to make sure you do not pick up an offense for driving under suspension. With a qualified DUI attorney, you may be able to avoid having your license suspended at all which is why your choice of attorney is so important.

However, if you do find yourself in a situation where you have been charged with driving under suspension, I would notify the attorney handling your DUI who can now help you with these charges. Although this offense is punishable by jail you will typically just have to pay a fine. Jail time becomes increasingly more likely and in some cases mandatory with multiple subsequent offenses. It is however important to note that having new charges will not help your chances at the best deal possible with your pending DUI matter.

If you have questions concerning your Driving Under Suspension Charges, call Suhre & Associates any time at 312-450-6639 to speak with an attorney and find out what can be done in your particular situation.

If you are an individual charged with a DUI it is in your best interest to hire a qualified private attorney for many reasons. Perhaps one of the most important is that public defenders in IL cannot represent a defendant in a hearing on a Petition to Rescind.

This is the hearing where the Statutory Summary Suspension of your driving privileges is contested. The reason a public defender cannot represent someone in this hearing is because it is civil NOT criminal. Thus, the public defender’s office will not contest your license suspension.
